Overview

David’s practice focuses on cross-border dispute resolution. With experience in both litigation and arbitration, David has handled matters in a wide array of sectors, including energy, construction, infrastructure, telecommunications, media, joint ventures, and shareholder agreements. Fluent in French, Arabic, and Spanish, he commonly deals with parties in Latin America, the Middle East and Africa. He also has experience with international asset tracing and judgment enforcement, as well as compliance matters related to corporate practices, anti-corruption and economic sanctions.

David has been part of the UNCITRAL Working Group II on Dispute Settlement, regularly contributing to developments in the UNCITRAL Arbitration Rules. He currently serves as Secretary to the Global Steering Committee of the Campaign for Greener Arbitrations, and has acted as a consultant to the Organisation for Economic Co-operation and Development.

Representative Matters

  • Represented a Middle Eastern sovereign in connection with a federal forfeiture action to recover over $100 million stolen by a former high-ranking government official.
  • Represented a U.S. company in judgment enforcement proceedings against a Latin American state-owned energy company subject to economic sanctions.
  • Represented victims of sex trafficking against several major online content streaming companies and Visa before the U.S. District Court for the Central District of California.
  • Represented the wind-down debtors of a multibillion-dollar cryptocurrency platform and “crypto bank,” in the Chapter 11 proceedings of BlockFi and FTX.
  • Represented a consortium of contractors hired by an East African State to construct, on a turnkey basis, a wastewater treatment plant in one of the most populated cities in East Africa, as part of the State’s efforts to provide ecological protection to the largest lake in Africa.
  • Represented a European joint venture against several of its shareholders and directors in the energy industry in relation to the violation of long-term commitments and fiduciary duties (ICC arbitration).
  • Represented the BVI Liquidator of the Fairfield Funds (the largest feeder funds into the Madoff Ponzi scheme) in the Funds’ Chapter 15 case in the U.S. District Court for the Southern District of New York.
  • Counsel to a Caribbean energy exploration company in several disputes against a North African state regarding the expropriation of the company’s share of production in an offshore concession and the withdrawal of offshore exploration permits (ICC Arbitration).
  • Represented a Luxembourg telecommunications company in a post-M&A dispute with a company in central Europe (ICC arbitration, English law).
  • Represented the Official Committee of Talc Claimants in the Chapter 11 proceedings of Johnson & Johnson’s talc liability special purpose vehicle, achieving dismissal of an $8.9 billion plan based on lack of good faith/financial distress.
  • Counsel to German and Brazilian subsidiaries of a French water management group against Swiss and Brazilian subsidiaries of an American energy group in connection with the construction of a water treatment plant in Brazil (ICC arbitration).
  • Counsel to a Saudi investor in an arbitration relating to the performance of a partnership agreement over the management of a public cement plant in Algeria (Algerian law).
